These Terms of Service (the “Terms”) constitute a legally binding agreement between you (“you,” “user,” or “Client”) and InkedIn LLC, a Virginia limited liability company doing business as FunnelVision AI (“FunnelVision AI,” “Company,” “we,” “us,” or “our”). These Terms govern your access to and use of the FunnelVision AI website (https://funnelvisionstudio.com), software, content, tools, SMS/MMS communications, and related products and services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms, as well as our Privacy Policy and any other policies referenced herein. If you do not agree with these Terms, you must immediately discontinue use of the Services.

1. ELIGIBILITY

You must be at least 18 years of age and have the legal capacity to enter into these Terms. Use of the Services is void where prohibited by law.

2. SERVICES PROVIDED

FunnelVision AI provides SaaS tools for customer relationship management (CRM), marketing automation, digital advertising, lead nurturing, and business operations primarily targeting U.S.-based small businesses. Services may be updated, modified, or discontinued at any time.

3. DATA COLLECTION & PRIVACY

By using the Services, you authorize FunnelVision AI (service of InkedIn LLC) to collect and process personal and business information including, but not limited to, names, email addresses, phone numbers, locations, and analytics data. Use of cookies and third-party tracking tools may be implemented.

We do not share, sell, or otherwise disclose your mobile information (including phone number) with third parties for their marketing purposes. Your SMS consent applies only to FunnelVision AI communications and will not be transferred or resold.

All data will be handled in accordance with our Privacy Policy and applicable laws including CalOPPA, GDPR, and CCPA.

4. USER ACCOUNT & SECURITY

You agree to maintain the confidentiality of your account login credentials. You are fully responsible for all activities that occur under your account and must immediately notify us of unauthorized access.

5. INTELLECTUAL PROPERTY

All intellectual property associated with the Services, including software, content, branding, and documentation, is owned by FunnelVision AI (service of InkedIn LLC) or its licensors. No rights or licenses are granted except as explicitly set forth in these Terms.

6. ACCEPTABLE USE POLICY

You may not use the Services to:

• Violate any local, state, or federal law

• Send unsolicited commercial messages (spam)

• Engage in deceptive, abusive, or fraudulent behavior

• Infringe on third-party intellectual property

• Engage in unauthorized data scraping or reverse engineering

Violation of this policy may result in suspension or termination of your account.

7. A2P & SMS COMPLIANCE

By opting into SMS communications, you consent to receive messages from FunnelVision AI (a service of InkedIn LLC), including automated appointment notifications, and transactional texts. Message and data rates may apply. You may opt out at any time by replying “STOP.” Our Services comply with all A2P 10DLC messaging regulations.

8. FEES AND PAYMENTS

You agree to provide accurate billing information and authorize us to charge your designated payment method for all Services rendered. Subscription fees are billed automatically on a monthly basis unless otherwise specified.

9. SETUP FEES

All onboarding, configuration, or setup fees are non-refundable once any onboarding services have commenced. These fees cover time, strategy, and labor expended by our team during your initial setup phase.

10. SUBSCRIPTIONS OR RETAINERS

Your subscription will automatically renew monthly unless canceled prior to the end of the current billing cycle. You may cancel at any time through your account dashboard or by contacting support. Subscription fee changes, if any, will be communicated in advance in accordance with applicable law.

11. REFUNDS AND GUARANTEE POLICY

We offer a 30-day satisfaction guarantee on your first subscription payment. If you are unsatisfied, you may request a full refund of your subscription fee within 30 days of the initial charge. This guarantee does not apply to onboarding or setup fees. Refunds requested after 30 days may be issued at our sole discretion and may be prorated.

12. THIRD-PARTY TOOLS & LINKS

The Services may include integrations or links to third-party platforms. We do not control, endorse, or assume responsibility for third-party services or content.

13. TERMINATION OF SERVICE

FunnelVision AI (service of InkedIn LLC) reserves the right to suspend or terminate access to the Services at any time, with or without cause. You may also terminate your account by notifying support in writing. All obligations under these Terms shall survive termination, including payment obligations and data disclaimers.

14. EARNINGS DISCLAIMER

FunnelVision AI (service of InkedIn LLC) does not guarantee any specific results, income, or business growth through use of the Services. Any examples or case studies are for illustrative purposes only and do not constitute promises or representations of typical results.

15. DATA RESPONSIBILITY

While we take commercially reasonable steps to safeguard and back up user data, we are not liable for any loss, deletion, or corruption of data. You are solely responsible for maintaining backup copies of all business-critical data.

16. ELECTRONIC SIGNATURES AND COMMUNICATIONS

By using the Services, you agree that all notices, agreements, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing. You further agree that checking a consent box or submitting a form constitutes your electronic signature.

17. MODIFICATIONS TO TERMS

We reserve the right to revise these Terms at any time. Updates will be posted on our website with an updated effective date. Continued use of the Services after such changes constitutes your acceptance of the modified Terms.

18. GOVERNING LAW

These Terms are governed by and construed under the laws of the State of Virginia without regard to conflict of laws principles.

19. DISPUTE RESOLUTION

Informal Resolution

Before initiating formal dispute proceedings, you agree to attempt informal resolution by contacting us at support@funnelvisionstudio.com and allowing at least thirty (30) days for a resolution.

Binding Arbitration

If a dispute cannot be resolved informally, you agree that it shall be resolved exclusively through binding arbitration in Fairfax County, Virginia. Class action lawsuits and jury trials are expressly waived. Each party shall bear its own legal fees, unless otherwise awarded.

20. LIMITATION OF LIABILITY

To the fullest extent permitted by law, FunnelVision AI (service of InkedIn LLC) shall not be liable for indirect, incidental, consequential, or punitive damages, or loss of data or profits, arising from use of the Services.

21. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless FunnelVision AI (service of InkedIn LLC) , its officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of your use of the Services or violation of these Terms.
